It has always been legal as long as the motor choice complies with the rules.
Once you start cutting the firewall things get difficult and expensive from an engineering/certifying perspective.
Cut enough of the firewall/floorpan and it starts getting into ICV territory.

It depends on the engineer you use and how much of the firewall/floorpan you're cutting away.
